Flying High: TSA Changes Stance On CBD Products

It’s now legal to travel on commercial airlines with CBD products. TSA quietly changed stances on a previous policy that noted medical marijuana, including CBD oil, as no-gos for either checked luggage or carry-on bags.

On the TSA website today, you’ll find a message that reads:

 “Products/medications that contain hemp-derived CBD or are approved by the FDA are legal as long as it is produced within the regulations defined by the law under the Agriculture Improvement Act 2018.”

This is great news for travelers who suffer from chronic pain or anxiety while flying. CBD has been known to also help with inflammation, an issue everyone experiences while flying.

The bad news for some passengers, however, is that marijuana and “certain cannabis-infused products, including some Cannabidiol (CBD) oil, remain illegal under federal law.” The exception being products that contain no more than 0.3 percent THC.

TSA says their screening procedures are centered on security and are “designed to detect potential threats to aviation and passengers.” That being stated, TSA security officers do not search for marijuana or other illegal drugs, “but if any illegal substance is discovered during security screening, TSA will refer the matter to a law enforcement officer.” And of course, if you’re in a state where marijuana is legal like California or Colorado, you’re likely avoiding any severe penalty.
